– “Services” encompass website design, development, maintenance, and related services offered by Evolution Designers LLP.

– “Website” denotes the digital platform designed, developed, or maintained by Evolution Designers LLP.

Scope of Services

Evolution Designers LLP specializes in delivering website development services, including website design, development, and maintenance. The specific scope of services will be outlined and agreed upon through our email correspondence.

Client Responsibilities

The Client commits to providing Evolution Designers LLP with all necessary materials, content, and information essential for the project’s timely completion. Failure to do so may lead to project delays or additional charges.

Acceptance of Terms

The acceptance of these terms and conditions is implied when a Client engages our services. By doing so, the Client confirms their understanding of these terms and agrees to be bound by them.

Charges and Payment

  1. Charges for services provided by Evolution Designers LLP will be discussed during our email correspondence. Evolution Designers LLP retains the right to modify or decline providing a quotation.
  2. Unless otherwise arranged with the Client, all website design services necessitate an initial payment of a certain percentage of the project quotation total before work commences. The remaining balance is due upon project completion, before the website’s launch or release of materials.
  3. Payment for services is to be made following the terms specified in the invoice. Payment methods may include bank transfers, with payment details shared through email correspondence.

Client Review

Evolution Designers LLP will offer the Client an opportunity to review the website’s appearance and content during the design phase and upon project completion. It is expected that the Client reviews and approves the materials within a suitable timeframe. Failing to provide feedback or approval within the agreed-upon timeframe may result in project delays.

Project Timelines

Evolution Designers LLP is committed to delivering the Client’s website within the agreed-upon timeframe. However, it is important to acknowledge that, despite our best efforts, certain unforeseen circumstances may occasionally hinder project completion within the originally specified timeframe. Such circumstances may include, but are not limited to, delays in receiving necessary information, content, or approvals from you, delays caused by third-party services or companies (such as hosting providers or domain registrars), acts of nature, emergencies, or other unforeseen events. We will make every reasonable effort to adhere to the agreed-upon project timeline, and any significant delays will be communicated to you as soon as they become evident.

Web Browsers Compatibility

Evolution Designers LLP designs websites for compatibility with the most widely used web browsers at the time of development. While we aim for compatibility across various operating systems, we cannot guarantee functionality with all browser software.

Default and Termination

  1. Accounts unpaid after the specified due date will be considered in default. In such cases, Evolution Designers LLP may remove materials from its servers, but we are not responsible for any loss of data incurred due to such removal.
  2. Termination of services by the Client must be requested in writing and will become effective upon our receipt of such notice. The Client will be invoiced for work completed until the date of cancellation and must make payment within the specified timeframe.

Design Credit and Access Requirements

Evolution Designers LLP may include a link or credit on the Client’s website, as per industry standards. The Client also agrees that the website may be presented in Evolution Designers LLP’s portfolio.

Copyright

The Client retains copyright to data, files, and graphic logos provided by them. The Client grants Evolution Designers LLP the right to publish and use such material for the project.

Content Liability and Disclaimer

Evolution Designers LLP is not responsible for the content and information displayed on the websites we design and develop. The content, opinions, and views expressed on these websites are solely those of the website owners and do not necessarily represent the views or opinions of Evolution Designers LLP. We do not endorse or assume any liability for the accuracy, legality, or appropriateness of the content on client websites. Clients are solely responsible for the content they choose to publish on their websites and must ensure it complies with all applicable laws and regulations.

Post-Placement Alterations

Evolution Designers LLP is not responsible for alterations made to the Client’s website by third parties after installation.

Additional Expenses

The Client agrees to reimburse Evolution Designers LLP for any additional expenses that may be incurred during the project, including but not limited to the purchase of stock photos, software licenses, or any other third-party services necessary for the completion of the work. Any such expenses will be discussed and agreed upon in advance with the Client and, unless otherwise stated in our email correspondence, will be the responsibility of the Client.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The parties agree to replace the invalid or unenforceable provision with a valid and enforceable provision that most closely achieves the intent and purpose of the original provision.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts in the UK.

Liability and Force Majeure

  1. Evolution Designers LLP, its employees, and agents are not liable for loss or damage caused by inaccuracies, omissions, delays, or errors in website production.
  2. The total liability of Evolution Designers LLP for any claim arising out of this Agreement shall be limited to the charges paid by the Client under this Agreement.
  3. Evolution Designers LLP shall not be liable for delays or failures to perform under this Agreement due to events beyond our control, including force majeure events such as natural disasters, emergencies, or other unforeseen circumstances.
